Incidentally, in Texas (especially Harris County) the shot to the kneecap to protect ones property would likely be no-billed by a grand jury. Google "Joe Horn."
Even if Texans' right to use deadly force wasn't somewhat expansive (it can be used to protect property in certain circumstances), the crime would most likely be charged as aggravated assault. It's easier to prove the complete crime (the aggravated assault) rather than the inchoate crime (the attempted murder).
In any case, I'm pretty sure both carry the same punishment in Texas.

First of all, Bush isn't in the Senate. He didn't draft this bill, nor did he try to 'get it in place', and McCain signed on to the bill after it was drafted, he didn't help draft it or put it in place. It was actually introduced by Chuck Hagel, who, although he is a Republican, is hardly a fan of the Bush Administration. The Republicans who controlled the Senate at that time did not even bring the bill up for consideration. It seems that people on both sides of the aisle had reason not to see this one pass.
The American Enterprise Institute, hardly a liberal organization, considered this bill co-sponsored by McCain to be seriously flawed.

If the guy shot somebody and killed him, then turned around and said he intended to shoot him in the knee and not kill him, it would be pretty hard to prove intent. On the other hand, If they guy noticed his previous sign stolen the night before and said, "Goddamn it, I will KILL the guy who keeps stealing my signs!", and his neighbor actually heard him say that, that would be intent and premeditaton.

wasn't there a case a few years ago about a guy that kept getting his car vandalized by some kids, so he camped out on the roof of his apt with his ar-15 and waited for the kids to show up again, then blasted 3 of them? iirc, that was considered defense of property as well. the politico signs might fall under that same precedent.

And when I said, “You can’t do that,” he took the stick from the sign and started beating me on the head with it. He broke the skin on my head, he scratched my wrist, and almost broke my glasses, and then he left.
I followed him down the stairs to the subway until I could get the police and I said, “You’re not going to get away with it.” And as soon as he saw the police he immediately went calm. He still had the stick in his hand, and you could see the injury on my face, and he admitted it. He was arrested. He actually said, “I don’t know why I did this. It’s just those signs, and this election, it has me so upset.”
