Adding to this weeks car accident threads here are my two.
Last Friday, the first day of spring I was driving home from work in a bit of snow when I changed lanes to let people merge onto the parkway. The back came around and I spun into the guardrail wrecking my car.
The following Monday I went and borrowed my parent's extra car, a 2000 Daewoo that has never given them a bit of trouble. I had it 15 minutes and it decided to stall getting onto the Throgs Neck Bridge. I pulled over to the right, put my flashers on and tried to restart it. For several minutes traffic flowed around me until Silver Van Man came along to hit me. Then I got a call on Tuesday from my parents insurance company saying he claims he stopped and I backed into him at a high rate of speed. I can't wait to see what goes wrong next.

I think a decent accident investigator will look at your car and probably side with your description. The impact on your car looks to me like he was trying to avoid you but did not quite make it. Also do you have any photos of the car rite after the accident that show the tire marks? That would be conclusive if you do.
Sorry for all the bad luck.
Was the photo you took after you moved the car? Looking at the concrete I can see what look like tire marks / skid marks that show your car being pushed. You would not get that if you were doing what the other driver said you were doing.
Please tell me that bridge has traffic monitoring cameras that show you stopped, with your four-ways on, while Silver Van Man arrives.
I wouldn't worry too much about the moron trying to claim you backed into him at high speed. First, in my 18+ years, I don't know I've ever seen that extent of damage from someone backing up on the roadway. That's pretty clearly a rear end accident. Second, if the car isn't running, it'd be rather hard for you to back up unless your name is Fred Flinstone.
There looks to be a skid mark behind your left front tire showing that you were pushed forward along with some scrapes in the concrete road behind the right rear of the car parallel to the wall. Glad you're still here! That looks like a hard hit!

What did the police report say about the Daewoo accident? That should be the report the insurance company should go with.

That van-guy story would make my neck really, really sore. Maybe with headaches and blurred vision.
My VERY quick look at this photo and you will see that I highlighted what appear to be skidding marks on the pavement that line up with your tires. Also note that they are slightly offset from the vehicle that directly correlates to the offset impact from the van. This would not be there if you hit him as you would not have been on the brakes and even if you were on the brakes backing up the skid marks would be the other way.

You ran into him at a high rate of speed in reverse? Did the officer keep a straight face when he heard this?

Even if you feel ok get checked out you don't want that to creep up on you later (as it can). If you cheack out ok it is one less thing to worry about.

I got some nice pics of the skidmarks and scrape. They are about 15 feet long, and he left a couple that were about 20. There are cameras everywhere thanks to war of terror that our insurance was looking into. I went and got checked out that night and was really sore for a couple days but am feeling pretty good now.
Insurance companies are happy to ignore the police report if it suits their needs. We were in an accident a few months ago where we were rear-ended, and another car hit the car that hit us. Despite what the police report said, neither insurance company accepted responsibility for our damage. We ended up fixing things out of our insurance, and then will get our deductible back when it goes to arbitration and they figure everything out.

we had one where the wife backed up into a truck that had whipped into the handicap spot to let his wife out as my wife was backing out of her spot. The cop wrote him up and gave him a ticket for parking in the handicapped spot.
we still were at "fault" by the insurance company...

I daily drive a full size 4x4 pickup with a V8 and a tow package and I DONT TOW, EVER and only load the bed a few times per year at Home Depot or Lowes.
We'll both be burned at the stake!
