Got a text from SWMBO this morning:

SWMBO said: Thank god i took your Jeep. Got sandwiched on Thompson. Giving info to cops now. Got hit hard. Neck hurts. Hit my knee hard. But Jeep still starts.

Called her.

Apparently 3rd car in front of her stopped for some geese in the road. Small side road, 35mph limit.

Nissan Altima successfully stopped, Lincoln whatever that thing is stopped, and the Cherokee (not known for great braking prowess) stopped just fine. About 3 seconds later she looked up in the rearview mirror and saw the silver Caravan barrelling up behind her. No nose dive, no brakes, no nothing.

Got hit. Hard. Caravan had to have been going 50-60mph. Surprised she didn't get a ticket and/or charged with attempted manslaughter.

Yes, the "thank god i took your jeep" was in reference to her almost taking the 2000 Miata to work this morning. That wouldn't have been quite so good i don't think. Very impressed with how the Cherokee took the hit, even without having any fancy anything. (Doesn't even have airbags.)

The goal with insurance is going to make them "replace" it with another facelift 2dr 5spd 4x4 4.0 Cherokee. There's one for sale in the entire US right now.

Goes with out saying she should get to the hospital ASAP. (if she did not go already) I have a long drawn out story about this kind of thing. The sort of it is 30 years later and my neck is still a PITA at times.

Yes she has an appointment in the morning with her regular doctor, and i told her to push to go get scanned or whatever. I normally don't condone going after insurance companies for personal stuff like this especially since my health insurance will cover it at 100% out of my HSA, but the negligence of this lady pissed me off. We'll be going after them for every last penny we can.

So.... now let's turn this into a "How do i get the most money out of insurance" thread. Never had a collision claim before.

We'd like to be reimbursed for:
1) Unicorn XJ
2) Loss of use over "normal" amount of time in lieu of a rental (30 days @ $30 day)
3) Loss wages (missing work today, maybe tomorrow)
4) Missing school today
5) Medical bills (coming out of HSA, i'll take reimbursement in cash)
6) "pain and suffering?"

Or do we just press charges under the evidence that she was going nowhere near the speed limit and gross negligence in not even attempting to hit her brakes?

Your insurance may pay for the Lincoln , maybe the hitters.

Let the insurance companies fight it out.

don't sign off until you are sure your wife will be OK.

It's a WJ Grand Cherokee thing.

"Pain and suffering" is not something you'll get from your insurance company. You'll have to make a lawyer rich instead. Make the world a better place, let it go and concentrate on the Jeep instead. Let the cops press charges if there are charges to press, but if she didn't lock up the brakes and leave some nice long skidmarks that's not going to happen.

I'd be tempted to take that unicorn to a frame shop and see what they can do. You'd be surprised.

Do you have evidence she was going that fast? That certainly doesn't look like a 60mph collision. Not even remotely close.

RE: List:

1) Unicorn XJ - good luck. You'll get book, maybe high book. Unless you have it insured for additional value with your own insurance company. If you have it insured like the $3000 (ish) car it is, you're going to get $3K for it.
2) Loss of use over "normal" amount of time in lieu of a rental (30 days @ $30 day) - No idea. Again, good luck. Or enjoy rental.

You should alert your insurance company ASAP that all bills associated with this are related to this accident/claim # and have them bill the other insurance company directly.
6) "pain and suffering?" Negotiate.

Remember, you don't have to accept anything they offer you. Negotiate on everything. The medical and damages settlements are separate. Do not accept anything medical until your wife is totally checked out and O.K.

I agree completely.

As far as the frame/unibody. When my 944 turbo was totaled, and one rear frame rail really screwed up, it took 10 hours on a frame rack to straighten it. They only charged $50 an hour, so I was tracking straight for just a tick over $500. I paid very little to buy it back, so after the chassis work I was still under 1k total.

No evidence besides pictures. There was a good 15-20 foot gap between the Lincoln and Cherokee prior to them "meeting," though. Lincoln was also pushed into the Altima in front of it.

Just seems like an AWFUL lot of damage/carnage for a speed limit hit.

The value of the Unicorn XJ i don't think is going to be TOO bad... the insurance company previously paid an amount that i thought was absurd on the blue jeep when the meth heads cut the cat off of it to replace the exhaust. When i inquired how close it was to being totaled, they said it wasn't that close. Unicorn should be pretty easy to prove value higher than that of blue jeep.

I'm just trying to not get totally berkeleyed here. I can't get anything near as good for $3k.

Keith and Cotton: I wouldn't have thought of that, frame damage is a scary and unknown thing to me. My neighbor works at a body shop, does the frame work. I'll see if he can take a peek at it tonite and see if it's worth fixing. My problem now is that the only straight panels on the rig anymore are the doors. Everything is buckled. I'm guessing a LOT of time on the rack, and that might get me a jeep that drives straight but still looks like total hell. I'm not really interested in that sort of thing anymore for my DD.

Really sorry to hear about your Jeep, just picked up a 96 2 door 4x4 5 speed myself, but glad SWMBO is OK. Also glad to see they can take a hit.

I had a pretty similar accident kill my e36 in March or '14. Friday afternoon on my way home from work, slowing to make a right turn onto my fun route home and just as I start turning the wheel I catch something coming up FAST in the rear view. Next thing I know, I'm sitting in some dude's lawn saying out loud " Holy E36 M3, how the berkeley am I OK right now?" Guy hit me with a Tacoma, easily doing 55-60, with only about 20 ft of skidmark before the point of impact. Guy must have either been texting or stoned, because he had nothing but perfect visibility for over 1/4 mile. Fortunately we were both fine and he immediately admitted fault.

I made out REALLY well on his insurance, got over $5k when the car booked for about $2k. Best part was when the insurance called back about 5 min after making that offer and asks "Oh BTW, how many miles were on the car?" Uhhh, 207,000

Every time his insurance company called, the first thing they would ask is how was i feeling. I never went to the hospital or anything, felt fine after the accident and was only a little sore the next day so I didn't feel it was warranted. But I always made the conscious effort to imply to the insurance they could be having thousands in medical bills headed their way at any instant. "I guess I'm feeling ok, for now" I think the threat of large hospital bills and the fact that their driver admitted 100% of fault weighed heavily into their valuation of my Bimmer.

So all that being said, will you be doing a part out
