As far as the seat is concerned, Geico already told me to get a new one and submit the receipt for reimbursement. They’re still working to assign fault and get the ball rolling. They recommended I start my own claim with my policy, pay the deductible and they will reimburse it once the original claim has fault assigned and the responsible party is paying.

Yes, you'd be far better off going through your own insurance company in this situation.  You'll get all, or at least some, of your deductible back down the road.  However, going through your own carrier will be quicker.

You shouldn't have a hard time regarding the car seat from the insurance company.  It's pretty standard operating procedure to pay for one after an accident. 

It's a wonderful world we live in today...the Versa did its' job in protecting the occupants, just like pretty much all newer cars on the road today.  The safety advances in the past 20-30 years have been amazing.  We've come a long way from the days when I would see the very sad results of a 1993 Chevy Cavalier take a rear (or side, or front, or any) hit.

Thanks Man, glad you chimed in, i know you have experience with this sort of thing. I did my own claim this morning, they did say there’s no guarantee on getting my deductible back. But I will have someone out this week or next to look at the car, hopefully I can get my GAP covered soon and find a new ride. The safety advances are amazing, the car did everything it was supposed to do. I’m very thankful for that.

Wow. Just one more for the chorus of "Glad everyone's okay." A lot. That looks like a heavy hit for a situation where most of the surrounding traffic was stopped.

Thanks, according to the witness who stayed at the scene said the Solara who hit the Rav4 was going way to fast. I noticed her in the mirror before the accident and thought "boy that car is really moving". The witness thinks she was between 50-60 mph. It wouldn't surprise me given she went through 2 cars and still stopped 50 or so feet beyond my car.

That's why it's a good thing you filed with your carrier.  From what you've written, and the few photos I've seen I can envision this getting a bit hairy.  From what you've said, the Solara would have had the right of way.  However, if they were indeed speeding, which can be a tough one to prove unless the carrier wants to...or can...retrieve data from the vehicles' EDR, that could throw in comparative negligence.  You are an innocent third party and have no negligence, but the Rav4 and Solara carrier may not wish to take on the full cost of your claim up front.  Plus, there could be a liability limits issue.  Off the top of my head, I don't recall what TX state minimum limits are.  You're better off going to your own carrier, letting them make you whole (minus your deductible) and let them sort it out with the other carriers.

I would expect that you'll get it back eventually, unless one of the cars was uninsured or didn't have enough insurance.  You were an innocent party, so you'd be entitled to reimbursement.  What will likely happen is your carrier will submit what they've paid for your car to the party they feel is majority liable, which is probably the Rav4.  That will include your deductible.  The RAV4 carrier say "We're not 100% liable, we'll offer you 70%, you need to get the other 30% from the Solara".  If the Solara carrier agrees to pay the other 30%, you're golden.  If not, your carrier will reject the offer and file arbitration against both the RAV4 and Solara carriers.  Arbitration is used by most auto insurance companies instead of clogging up the court system even more than it already is.  The arbitrator will then decide how to split up the liability between the RAV4 and the Solara.  That decision is legally binding.  I'm an arbitration panelist myself (we're volunteers in the industry), it's actually pretty fun stuff.

And fortunately if your company files inter company arbitration against the other two, you as an innocent party are guaranteed a 100% liability recovery, they have to find a way to split it among the other two.  Like Klayfish said, the only problem would be if someone is un/under insured.  I’m also an arbitrator.

Great information Klayfish, I appreciate that insight. The versa is confirmed totaled now, $12,500 in repairs would be needed according to the appraiser. They valued it super high, so i'm getting some money out of it as it was more than my payoff. I'm glad I ended up doing this claim through my side so I can get the car stuff handled while they do what they need to do to get stuff covered.

Good to know there is another insurance person on the forum. This is my first major accident so I've never dealt with anything. Geico has been top notch through this whole thing so far, so i'm lucky so far.

So the hits keep coming, car was totaled, ended up with positive equity and some money for my injury. Can’t get financing for a stick of gum right now, even with my parents perfect credit co-signing. So I need a car, coworker has a 140k mile Toyota Venza that’s in great shape, will sell for $5k, my parents are offering to float me $5k, however he can’t sell the car until he’s replaced it. So I can either keep my rental until he replaces it which could be a few weeks. Or find something for under $5k on Craigslist. I need space for 2 car seats and good gas mileage since I drive 60 miles a day.

That Versa looks perfect for your situation. 

I've been shopping for a cheap car for a college student. I am amazed at the low prices on non-sporty cars with manual transmissions.  It's like no one goes shopping for these so if you do you can almost name your own price. 

As an example, Ford Fiesta trunk models with manual trans are down in the 2k range with 140k miles but 2011. 

Open your local CL.  On the right side choices put in your price max the specify manual trans only. Hit search and see all your local choices

The Versa was a decent little rig. That one looks like a decent deal. I’m glad you mentioned the manual search, I couldn’t find anything this morning when I looked. I think all 4 you showed are great candidates. The soul actually fits what I need really well, since i do mobile detailing and carry large amounts of equipment with me.

How do we feel about Honda Fits? I drive 60 miles a day, most of it is stop and go, with some 70 mph highway. I know they’re a pretty fun car overall, I just need reliability and economy. This one seems to fit the bill nicely (pun not intended).

I have not owned. Fit but everything I hear is good.  

I looked at that dealers ad and I see that it includes the carfax.

It shows that this car has spent all its life in Upstate NY. The pics don't show it but expect undercarriage rust unlike anything you have ever seen in Austin, TX. 

 

There is never a good reason to choose the northern car over the southern car.

I saw that it spent its life up north. Rust is definitely a concern, the silver one is definitely one im considering, I don’t like the light blue all that much. But it’s cheaper and not from the North. That has to count for something. Both the light blue and the dark blue are at the same lot, so I’ll look at both.

We had a 1st gen Fit, 5spd.  We loved it.  Roomier than a car that size has any right to be, tossable, reliable, great mpg.  Downsides were that it was slow, really slow, and it was a buzzbox on the highway.  It turned something like 4k rpm at 80mph, it made long freeway drives painful.

I've always liked the Fit, my concern is the highway. But the Versa did the same on thing, it was around 4k at 80 mph. I'm going to take a look at both today and see what I think. I also found a kia Rio5, anyone know anything about these things?
