guys i have abit of adilemma and i need your opinions
please
coworker i work with hit my toolbox with a skidsteer
i have over 28ft of tool boxes (up against the wall) not in an unsafe location(i thought)
the box he hit is the first good snap on box i had bought, the one that i committed to the trade with)
the box is now junk, had to work on it for hours just to get it to open/close and lock, its still junk
i found another used one (same age,model, condition) in indiana, 1000usd plus shipping,duty,brokerage
he doesnt think he should have to buy another box, claiming not his problem, not denying that he hit them tho
i gave him an option, clean out his box and we trade(i'd be losing a bit of space but its not wrecked)
third option is i lose my temped, drag his box out to the middle of the shop and get the skidsteer out myself!
any way,
what would you do?

For our entertainment, i would vote option 3. Only if there's well documented video of the event.
Otherwise, i'd beat home option 1 until he hates his life, then give him option 2 as an "easy way out." He'll take it.
I would take the skidsteer or a forklift, pick up his tool box, remove the casters and place it up against the wall with the drawers facing the wall and set it down.

If he doesn't think he's responsible for damage that he admits he caused, I'd suggest you slap his mommy and daddy, 'cause they missed something a while back.
And Karl's right, whatever happens.
Talk with your Boss and this person together in one room, get everything documented, and see if you can come to some sort of amicable solution.

Yep. Even if there's no trading or selling going on, this guy damaged your stuff. He's liable.

I would definitely try diplomacy first,via jfx001.Even though it would be beautiful,poetic justice and oh so satisfying to throw this hemorrhoid the beating of his life,it's the fast track to jail time,dept and unemployment.Not to mention the possibility of a severe knuckle infection should a tooth break off in your fist.This has happened to me before when I had no choice but to knuckle up.Despite the fact that I am a former boxer and MMA fighter I do NOT advocate NEEDLESS violence.That being said there are people who just need to be taught that there are consequences,sometimes painful ones,for their actions.
He owes you a replacement box of equal value,there are no two ways about it.If,after the "sit down",he still arrogantly refuses to man up I recommend joining a boxing gym and sparring for a while(but don't tell anyone) then challenge this guy to a grudge match with the following wager;if he wins you forget the whole thing,if you win he buys you the replacement box.That way it's a win-win situation for you;he buys you a new box and you get to sock the E36M3 out of him.

Make it your bosses problem, that's what they get paid to do. Your boss should either pay for it and get reimbursed from the other employee or turn it in to the shops insurance. If the other guy ran over the shop welder instead of your box what would your boss do?
Employers are responsible for employee actions plain and simple.

their just pissing around trying to get out of paying for it
i called the ministry of labour and got confirmation of the responsibilities and my rights
also that the min of lab would back me on this issue
