I hear it advertised to me a lot with the podcasts I listen to, but our household recently got a speeding ticket and I'm wondering if it might be worth looking into. The ticket is in a small Tennessee town on the NC border and I really don't want the points to affect our insurance rates. I've heard the judge often lets people go for some amount to cover administration costs, but should I really just show up and hope it works out or get some sort of representation?
I have no personal experience with it, but I have not heard good things about it locally (northern california). Minimal effort put into it, no contact, and fees charged without any real results.
No answer to the original question, but you can probably do a bit of research to see if the officer followed the letter of the law with a couple hours of googling.
I don't know about NC, but in MA you don't need to prove you aren't guilty, just establish "not responsible". While it seems like semantics, it's the different between proving you weren't speeding bs showing a high enough probability the reading could have been another car.
I've used the distance from a lidar ticket to show that with only 1/8" of an inch of movement at the end of the lidar gun, the officer could have been taking the reading from another lane or the car behind me (I was traveling down a hill toward the officer at the bottom).
Other things to look at are if there are minimum distances required for observing/estimating a vehicles speed before taking a reading to assess a ticket. My officer stated an estimated distance in court that was less than the minimum required in state statutes for the unmarked speed zone I was in.
It will take a bit of research and prep, but you can probably do the work on your own and have a positive outcome.
You could also have your speedo checked to see if is not correct. Then you could add in that what you saw on your speedometer was the speed limit in your mind.
