the dissentors are right, tho, this isn't a constitutional or even a civil rights victory.
what SHOULD have happened to make it one is that there should have been some type of 'civil union' law passed to give equal access to something demonstrably unavailable to gays thru current channels that is only available through marriage.
THEN, that should have been challenged as separate but not equal with demonstrable examples, a-la Brown VS Board.
THAT would have been a civil rights victory.

No argument the process has declined to a low that hasn't been seen for a while. Seems the rationale for decisions (pro and con) is drifting a bit. They say it's designed to be a messy system.
