I had my own near-death experience about a year back. Swerved to avoid a deer, all four tires unseated themselves from the wheels and the car smashed into several big trees.

I'd want it so she never drives in her life. I'd also want to crush her financially--not for my gain, but out of sheer spite.

I'm so glad to hear you were relatively uninjured---I'm still recovering post-surgery on a badly broken arm trying to get it back to normal. That sucks about the insurance but hopefully you have Uninsured motorist coverage (and for all those reading make damn sure you've got UNDERinsured coverage on your vehicle policy!) and you should be okay.

+100 on uninsured & underinsured coverage. My daughter was sideswiped and ran off the road and rolled a couple times a couple years ago. The new Civic did it's job and sacrificed itself and she was uninjured besides airbag rash and bruises. The lady didn't stop either. When she got caught she stated she ran because she didn't have insurance. Alabama (where I live) is a mandatory insurance state. She did 6-months in the pokey for felony hit-and-run and no insurance. My insurance took care of everything under the uninsured policy and tried for a year to get reimbursed by the lady that hit my daughter. They finally gave up. Kept us posted throughout the precedings.

What I've found is that most people without insurance can't afford insurance and those without a license lost it doing something stupid (usually DUI or drugs) but they still drive anyway because they need to get someplace. Can't squeeze blood from a turnip, they usually don't have a pot to p in so going after them would only cost you lawyer and court fees, even if you win and are owed by them. That's why I didn't sue the lady that hit my daughter, she had nothing to get. Maybe this 17-yo family has something though since they let her drive without a license. That looks to be a newer car she was driving.

No license, no problem, usually. As long as the owner of the car isn't going to press charges for auto theft on the driver, your damage will be paid for, if she is at fault and her policy is in order (paid to date, car listed, etc). She may have issues with her underwriting department and with getting insurance in the future, but not that much difficulty.

Gamby - unfortunately, there is little legal recourse against the driver, especially that my gut feeling is that there are likely little in the way of assets to go after. Her policy should cover it, unless it is state minimum, but that is a rant for another day

Very glad you are OK. Old cars are cool and I will have one to drive but my wife/kids will have the newest/safest stuff we can afford for every day because of that right there.

I hope it all works out for you. Definitely get with a doc and into physical therapy right away. I have many lingering problems from a similar crash but at lower speeds (probably impacted around 35-40mph in my case.) And don't accept an insurance settlement until you're 100% sure all your health problems have been addressed. And by that I mean wait at least a year before you sign off on it.

Sure glad your on the warm side of the dirt. Ive been in a whopper like that, and a Saturn saved my hide that time. An accident of that scale realy helps realign your perspective. Seeing that makes me even happier the 4cf household purchased a new GM vehicle - 60 mph impact, 2 of the generals cars, 2 talking survivors.

Good grief, that was definately a hard hit. Glad to hear you are OK and that you both were able to walk away from that. Wow.

17 years ago my mother was driving her 85 Impala when a 17 yearold pulled out in front of her. She hit the drivers door at 50+ MPH. The kid now has no spleen and has a permanant limp from the fractured pelvis. She walked away carrying my uninjured 1 year old nephew. No air bags in either car but big MO was on her side. She did have a sprained ankle.

DANG! Chevy vs Chevy....and they definitely lost that side of the battle!!! That Impala is mutilated, and you are right. Had there been a passenger, I doubt they would have made it. And if they did I'm sure there would be life long repercussions for sure.
