Does anyone fail a background check? It sounds like this guy was bounced from the Navy and then got clearance to work in the Navy Base. Along with Mr Snowden and Private Manning it sounds like there are a lot of people getting security clearance that shouldn't.

The only failures I have seen are for those that elect not to provide their SSN (which is optional on the form). The questions asked on the form are based on the honor system. Supposedly, the BATF does not keep a record of purchases or rejections; the gun dealer is required to do that. Also, the dealer may reject a buyer if the dealer suspects criminal intent or deception.

As for the clearance, I work in govt. We rejected one for a driving position based on a prior DUI. Had the job required use of a personal vehicle rather than a govt., he probably would have gotten in. The terror associated with hurting someone's feeling and then getting sued for discrimination makes it very hard to reject and/or boot people that don't belong. Our social climate basically keeps the govt. in a defensive position; hence the secrets and denial the govt. has turned into an art.

I think all this event does, as with the others, is to show that criminals don't pay much attention to laws. The fact that shootings always seem to happen in "gun-free" zones suggests something to me about the effectiveness of gun control, but both sides seem to think each event further proves their point of view.

I wasn't even thinking about buying the gun, but that from what I had just heard on the news that he was basically cleared to work for the Navy after being fired from the Navy.

I won't pretend to know the circumstances, but unless someone is discharged/terminated for a policy violation that specifically states 'may not be rehired', they're OK. Furthermore, actual termination is a last resort in govt. They get four or five strikes and then grievance hearings before they're let go. Since he wasn't dishonorably discharged, he was probably treated like any other contractor. I hire contractors and policy requires me to hire the lowest bid, not the least crazy.

BATFE is banned from keeping records by law. But yea, I don't believe I have ever seen anyone fail a 4473.

The govt is supposed to do and not do a lot of things by law... doesn't always work that way.

I actually have seen people fail background checks both for jobs and guns. Heck one guy got denied for something he did damn near 30 years ago.

I have actually had a delayed check before but the. It went through 15 minutes later. The person doing the checks was out to lunch.
